Abstract

Terjadinya proses globalisasi dalam sistem keuangan dan pesatnya kemajuan di bidang teknologi informasi serta inovasi finansial telah menciptakan sistem keuangan yang sangat kompleks, dinamis, dan saling terkait antar subsektor keuangan baik dalam hal produk maupun kelembagaan. Dalam kenyataan itu semakin diperlukannya pembentukan lembaga pengawasan di sektor jasa keuangan yang terintegrasi. Pengawasan sektor jasa keuangan telah terbentuk yang disebut otoritas jasa keuangan (OJK).

Abstract

This paper aims to investigate the views of the Islamic law and the lien position of the pawned goods (marhun). There are differences of opinion among the Fuqaha see marhun guarantee if lost in the hands of the murtahin not negligent in guarding it. there are three opinions. First, that is responsible for marhun murtahin in full, as there marhun disappeared on or hidden murtahin such as jewelry or clothing, or pawning goods are not supernatural at murtahin or may not be hidden like a house, animals, and rice before harvest. Secondly, that is not borne by murtahin marhun fully, both the goods lost or not lost on murtahin. So do not fall on each receives something of the debt, and as if the goods are destroyed (lost) on the owner, not by breaking the boundaries of one of them. The opinion according to school Shafi'ites, Hanabilah, David Dhaheri. It was narrated from Ali kw, 'Atha', Auza'i, Tsur and Ibn Abi Mandzur. Third, that the guarantee on murtahin, when it lost pawn goods, if the goods while the lien is not lost, it is not covered by murtahin, and not lost the debt. Marhun as if it is lost when it is on the owner, not by breaking the boundaries of murtahin, it is in line with the school Malikiyah.

Abstract

The results showed that the reform efforts in the formulation of economic laws of Islam and Islamic law generally coherent approach is fard 'ayn. By not intend going to negate the method which has been used by scholars, on behalf of our beloved nation benefit deem the proposal would marry fiqh with sociological approaches and mixes it with ethno-hermeneutics to produce legal products grounded and local flavor; Islam Indonesia.

Abstract

The interest system that developed in conventional banks, as matter of fact, is not relevant with the Islamic mission. According to Islam, the system included the ribawi category that not recognize practically which is haram and halal. The system has produced the uncomfortable condition among the moslems. To solve the problem, the Moslem economists have found the new system called it syari’ah bank. Practically, the bank pursues and emphasizes the profit and loss sharing (PLS) through variety of transactions such musyarakah, mudarabahand so on. With this system, the bank proved be able to face the economic crisis and accelerate the economic growth. So that, the system is not only applied in Moslem countries, but also in non-Moslem do the same thing as well.

Abstract

Political communications and power have a very strong relationship. The relationship can have an effect on the power of legitimacy. In the power context, political communications can be done with media. In political communications case of President Soeharto and President Abdurrahman Wahid, it was done with different impact. President Soeharto, as representation of repressive power, was able to eliminate the energy control the media so that media report on the reality of truth of power version. As the result, President Soeharto was able to maintain the power of legitimacy during 32 years and during that time the media freedom was bridled. President Abdurrahman Wahid was known with his jargon “media freedom” that exactly caused to mortgage his power before the end of his presidency term.

Abstract

Ibn Khald?n has promoted a concept related to economic thing. According to him, the property of a state is not based on the quantity of the money that the state has, but based on the capacity to produce the luggages and the needs. The concept at least lead a view how to build the human resources beside the natural resources. Both of resources should be balance in order to stabilize the economic of the nation.

Abstract

Zakat in Islamic  teaching has two perspective, ’ib?dah mahdah and social empowering. According to some ulemas, zakat has upgraded the standard of the umat life. In the ’Umar ibn Abd al-’Aziz era, zakatwas formatted as a modal for the poorman. The case of empowering umat became the important issue let alone many of them live in unfortune condition. What ’Umar ibn Abd al-’Aziz has done is considered as productive zakat. Nowadays, zakatusually is distibuted for consument importance. If the end model can not upgrade the condition ummat, so the productive zakatis considered a solution to cover the problem.
